2. COLLECTION AND USE OF DATA
We collect, process and use all your personal data that you voluntarily leave when shopping online in accordance with the Personal Data Protection Act, and exclusively to enable us to provide you with the products and services you want to meet your requirements or to adapt our offer to you, ie to personalize it. Consent is considered valid only if the person giving consent has been previously informed about the processing of their data.
We use your personal data for the purposes of concluding contracts at a distance, for communication with you, sending notifications, issuing invoices, and certain marketing and analytical purposes, as well as for our financial and accounting needs, and all of the above in accordance with positive regulations.
We will never misuse your personal data under any circumstances.
We take appropriate technical and organizational measures to protect against unauthorized and illegal access and processing of your personal data, including encryption of your information. We will retain your information for as long as necessary to process your order, your payment, issue a refund, respond to a complaint, or provide you with promotional information that you have signed up for.
Data that we collect are: Name i surname, e-mail, delivery address (street, ZIP, city, country), phone number.
Važno: the data content from your payment card is not stored in our database.
You can change your personal data (which you left during registration) at any time.
3. USER REGISTRATION AND USER ACCOUNT
User registration is not necessary for online shopping. So you have the right to choose whether you want to register or not. In any case, the data you leave is the same (listed in the section: Information about you).
When registering, you are required to enter the following information: Name and surname as well as e-mail address .
Registration benefits:
• You have your user account/profile,
• You can access the history of your overorders, a list of desired products that you can buy in the future, depending on the availability of items,
• You are not obliged to enter data during every purchase,
• If you agree, you will receive the newsletter by e-mail.
4. PURCHASE
The first step in shopping is adding items to the cart. When you have finished selecting the items, the next step is payment. Please make sure that all mandatory fields are filled with correct and required information.
After you receive a confirmation of receipt of the order (to your entered e-mail address), it is considered that the distance contract between the seller and the buyer has been concluded. Once you have concluded the contract, it is no longer possible to change the order.
Note : All items displayed on our website are part of our offer, but it may happen that a certain item is not available at the time of ordering. In the event that the ordered item is not currently available, the customer will be notified immediately, that is, no later than within 2 working days from the day of order confirmation. Also, part of our offer is only available on preorder (backorder). For all similar products, the expected delivery date is clearly indicated.
5. PRICE
All prices are expressed in euros (EUR). VAT is included in the price.
Prices are subject to change. The price change cannot affect the order for which we have sent the order confirmation.
Note: Given that the purchase takes place via an electronic platform, we reserve the right to make a mistake that it is possible that the selling price of the specific product at the time of concluding the contract may be incorrectly stated (obviously higher or obviously lower). In this case, the seller will notify the buyer immediately after noticing the irregularity, with an explanation of the reason for the error and offer to terminate the contract. If the customer still wants to keep the product, he can agree to an additional payment up to the correct price.
6. METHOD OF PAYMENT
You can pay for the product in two ways:
- Payment cards – VISA, Maestro or MasterCard
- Payment by cash on pickup (cash on delivery)
Payment cards
This payment method is available to all citizens whose payment cards support online payment. Payment by card are made in cooperation with AllSecure doo and Hipotekarna banka and is done in a safe and certified way via AllSecure Paymet Gateway , by simply entering payment card data.
After entering the card information and confirming the payment, the bank authorizes the transaction and thus the order is approved and enters the further process of preparation for delivery. The amount will be reserved on your card (account) and will not be available for other purposes.
The transaction will be completed and the amount deducted from your account at the moment when the order is confirmed. In the event that the payment is not completed, that is, the amount is not removed from the account within 14 days of accepting your order, that order will be canceled and deleted. After the expiration of the 14-day period, the money reserved in your account is released and will be available to you again. After that, you can repeat the same or a new order, and make a payment related to it.
Check with the bank that issued the card whether your card supports payment via the Internet.
Note: All payments will be made in euros ( € ). If the payment is made with payment cards issued by foreign banks, the transaction amount will be converted into the local currency of the card user, according to the exchange rate of Visa/Mastercard card companies.
7. PROTECTION OF CARD DATA
When entering payment card data, confidential information is transmitted via a public network in a protected (encrypted) form using the SSL protocol, applying the most modern methods of tokenization of sensitive data, and in accordance with PCI-DSS standards. The payment card information is not available to the merchant at any moment.
3D Secure protection for all merchants and customers – AllSecure Payment Gateway uses the highest global standards of data protection and privacy. All merchants who use the AllSecure Payment Gateway are automatically included in 3D-Secure protection, which guarantees the security of purchases to customers. Customers’ payment card numbers are not stored on the merchant’s system, and the registration itself is protected by SSL data encryption.
PCI DSS Standards – AllSecure Payment Gateway constantly complies with all requirements of card organizations in order to increase the security level of merchants and customers. Since 2005 year to date, without interruption, the system is certified as PCI-DSS Level 1, which represents the highest standard in the industry. PCI Data Security Standard (PCI-DSS) is a norm that defines the necessary security measures for processing, storing and transmitting sensitive card data. PCI Standards protect sensitive data about the cardholder during the entire payment process: from the moment of data entry at the merchant’s point of sale, during communications between the merchant and relevant banks and card organizations, as well as later storage of such data.
When the customer’s card data is TOKENIZED (entered in a certified manner for later use), at his request or by the merchant’s decision, that data is stored on AllSecure PCI-DSS level 1 certified servers. Card data thus tokenized are transmitted in a completely safe and certified manner. At no time does the merchant have access to data on the card number and other sensitive data, but receives a reference number (token) that only he can use in accordance with the conditions agreed with the customer. The customer has the option of deregistering a previously registered card, as well as changing the details of a previously tokenized card.
8. PRODUCT DELIVERY
We deliver exclusively on the territory of Montenegro. Delivery for all orders is €4. We deliver by courier service. Delivery time is typically 2-5 working days, except for products that are only available through backorder. For such products, shipping varies and will be highlighted on the product page as well as in the basket. The delivery period starts from the moment of order confirmation. Shipments are delivered to the delivery address on business days. Please ensure that during that period there is a person at the address who can collect the shipment. Delivery is considered completed at the moment of receipt of the goods by the buyer, which is confirmed by signing the order receipt. If it was not possible to make the delivery due to force majeure (storm or unforeseeable circumstances), we are obliged to contact you immediately, no later than the deadline for delivery, by e-mail by email or phone, and we agree on a new delivery date.
9. REASONABILITY OF THE CONTRACT
Pursuant to the Law on Consumer Protection, the trader is obliged to deliver the goods to the buyer in accordance with the sales contract.
Delivered goods are considered to be in conformity with the contract if:
• corresponds to the description given by the merchant;
• has properties required for the particular use for which the buyer is purchasing it, which was known to the merchant or must have been known to him at the time of the conclusion of the contract;
• has properties necessary for regular use of goods of the same type;
• has properties and characteristics that are explicitly or tacitly contracted or prescribed;
• in terms of quality and functionality, it corresponds to the usual characteristics of goods of the same type that the customer can reasonably expect.
The buyer is obliged to inform the trader about the non-conformity of the goods with the contract immediately after noticing the non-conformity, but not later than the legally prescribed period.
If the delivered goods do not conform to the contract:
- the customer has the right to choose between the request that the non-conformity be eliminated by repair or replacement, and if repair or replacement is not possible,
• the buyer has the right to ask for a price reduction or to terminate the contract, all in accordance with the Consumer Protection Act
• the merchant is obliged to carry out the repair at his own expense and within an appropriate period (taking into account the nature of the goods), but not longer than 15 days from the day of submission of the complaint.
In the event that the goods do not conform to the contract, the buyer submits a Complaint immediately upon learning, i.e. as soon as possible, i.e. within the period prescribed by the law on consumer protection, which you can download in the Objection/complaint section on the purchased product.
Complaints are sent to the e-mail: info@mamayer.com, and you will be informed about the further procedure within 8 days of receipt of the complaint, all in accordance with the law.
According to the Law on Consumer Protection, the buyer has no right to terminate the contract if the non-conformity of the goods is minor.
10. OBJECTION / COMPLAINT ON THE PURCHASED PRODUCT
Pursuant to the Law on Consumer Protection, the consumer has the right to file a complaint against an incorrectly calculated price/invoice, as well as a complaint due to non-conformity. You can download the complaint form here.
11. REPLACEMENT OF ARTICLES
If, after delivery, the customer determines that the item is not suitable, he has the right to request a replacement of the item. Exchange is possible only for another size or another article of the same or higher price category.
In this case, it is necessary to contact us immediately via e-mail info@mamayer.com, in order to check the availability of the desired size or the availability of another desired item, after which you will receive further instructions. The deadline for replacement is no later than 7 days from the day of delivery.
Note: When returning goods, it is mandatory to return the goods in a correct and unused condition.
“You are responsible for any decrease in the value of the goods, which is the result of handling the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods”. Upon receipt of the product, it will be determined whether the product is correct and undamaged. If it is determined that the product is defective or damaged due to the customer’s fault, the replacement will be refused and the product will be returned to the customer. The costs incurred in connection with the replacement of the item shall be borne by the buyer.
12. UNILATERAL TERMINATION AND REFUND OF FUNDS
You can unilaterally terminate this contract in accordance with the legal provisions related to consumer protection.
In order to be able to exercise this right, you must notify us of your decision to unilaterally terminate this contract immediately, and no later than within 14 days from the day of receipt of the product, using the Form for unilateral termination of the contract, which you can download here.
Please submit the form for unilateral termination of the Agreement immediately – without delay, by electronic means to the e-mail address info@mamayer.com and no later than the deadline indicated above, about whose receipt and further instructions we will also inform you electronically.
We will refund the amount paid immediately after the goods are returned to us, without delay, and no later than within 14 days from the day we were notified of the unilateral termination of the contract, provided that the goods are returned in good condition.
In the case of a refund to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the refund, this refund is made exclusively through the same VISA, Maestro or MasterCard card that was used for payment. This means that our bank will refund the funds to the cardholder’s account at our request.
Return of goods in case of unilateral termination of the contract
In case of unilateral termination of the Agreement, you are obliged to return the ordered goods that were the subject of the Agreement immediately, and at the latest within the above-mentioned period. You can return the goods directly to the retail outlet indicated on the invoice or by delivery by mail.
Note: You can see the name and address of the retail store on the fiscal invoice that you received with your order. The cost of returning the goods is borne by the buyer.
The buyer’s responsibility for the decrease in the value of the goods
You are responsible for any decrease in the value of the goods, which is the result of the handling of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods.
IMPORTANT: If you decide to unilaterally terminate the contract, please respect the following requirements regarding the goods:
1. The buyer tries the goods in the same way as he would do in the seller’s retail facility, to the extent necessary to determine the nature, characteristics and functionality of the goods.
2. The goods must be returned in their original, undamaged packaging.
3. Factory labels, as well as labels installed by the seller, must not be removed, damaged or reattached.
If the stated requirements are not complied with, the customer loses the right to terminate the contract and in that case we are not obliged to receive the returned goods and refund the money.
13. RELIEF OF MERCHANT LIABILITY
When publishing the properties of the items, we will publish all the information we receive from the supplier, but we are not responsible for possible errors (incomplete information) made by the supplier, and the damage that may result from this.
The images may differ from the actual product (color deviation, ie the difference between the natural color and the color in the photo), which cannot affect the product specification.
14. JURISDICTION FOR RESOLVING POTENTIAL DISPUTES
In the event of a dispute, you can initiate its resolution before one of the bodies designated for the resolution of consumer disputes, in accordance with the Consumer Protection Act.
If it is not possible to resolve the dispute amicably, the resolution of the dispute is within the jurisdiction of the court.
15. COOKIES
